Chin Peng::A Malaysian in exile?

Yesterday, MGG asked :: Is Chin Peng a Malaysian citizen? Chin Peng is said to have said :: "As Malaysian citizens, we pledge our loyalty to His Majesty the Yang di-Pertuan Agong and the country. We shall disband our armed units and destroy all our weapons to show our sincerity in terminating the armed struggle."
MGG has this to say regarding Chin Peng aka Ong Boon Hua and his citizenship ::
He is a Malaysian citizen because he was born in Kampung Koh, in Sitiawan, Perak, then part of the Dindings, whose main port, now known as Lumut, the British wanted as a naval base. The Dindings became part of the Straits Settlements in 1874, when it was ceded to Britain, in the Pangkor Treaty that brought its colonial overlordship over Malaya.

All born in the Dindings between 1874 and independence on August 31, 1957 had automatic Malayan citizenship, wherever they may be on that day. In all the years of the emergency and since, no attempt was made to revoke his citizenship. All he needs to prove is that he was born in the area.

MGG ends his article by saying :: "Chin Peng, a Malaysian and in his 80s, is not about to be allowed into Malaysia." And we wonder whether Chin Peng is again going to attempt to get into Malaysia and fulfill his hope of visiting and paying his repects at the grave of his parents in Sitiawan, Perak.

Today there is confirmation that this is so. Both Malaysiakini and Bernama reported that at the Penang High Court, Chin Peng has filed an application to return to Malaysia with hundreds of his comrades. The reasons for doing so being that he and his followers wish to come back to be good filial children and visit their ancestors, parents and family graves and eventually die here. According to Chin Peng, he and his followers had sought complied with the government’s conditions so they could return to their homeland and “live peacefully in our last days” but to no avail, so they have to resort to court action. They were willing to withdraw all court proceedings if they are allowed to return and settle in Malaysia, their homeland. According to MGG many other ex-CPM members have been allowed to return after the 1989 Haadyai Peace Accord was signed.

The latest from Bernama has Pak Lah saying that Chin Peng and his followers had the right to file the court application. Pak Lah said that it was up to the court to decide on their application and that the gomen would decide on the course of action to be taken based on the High Court's decision. The gomen rejected Chin Peng's earlier request to return home to visit his ancestral graves and launch his new book ‘Alias Chin Peng: My Side of History’ by giving the reason that he was linked to a banned organisation with a “history of perpetrating terrorism” in the country. The Ex-Servicemen's Association of Malaysia is also said to have called for the ex-CPM leader to be banned from entering the country. The way Pak Lah said it " there had been strong opposition by the various parties", others may have objected. Who are these parties? But what ever, lets wait for the court decide, now that the application has been made by Chin Peng and his followers.
